Robert Potter – The law is that business owners have to maintain their premises in a reasonably safe fashion or manner. They’ve got to maintain, make sure that there are no spills in the area, that they don’t have hazards in the area and they have a duty and responsibility to maintain their premises on a regular basis.
Ted Mann – What if they’re what if they’re building or premises is actually constructed in a way that there’s a dangerous condition present.
Robert Potter – Well, you may have to look at see if there’s an architect that may be responsible on down to a contractor and a design issue. But generally speaking, when you have a building or premises that is defective, then the business owner can be held responsible for your injuries.
Ted Mann – So, if I’m in a business and I slip, as the plaintiff, as the person injured, what should I do? What’s the first thing I should do?
Robert Potter – Notify the business owner of what happened and document what happened. If you have a phone or if a loved one is with you, have them take photographs and document what you slipped or tripped or caused you to fall and be injured.
